Philip Marshall – Lack of Evidence

Philip Marshall’s first wife, Ann Kallauner, told the Union Democrat she did not believe Marshall was a “Contra pilot.” She believes her former husband provided a taxi service for Barry Seal; a man who worked in black-ops smuggling drugs and guns in and out of the country for the CIA and DEA. So how much did Kallauner really know about her ex-husband? In the same interview she admits that Marshall was not always honest about his travels with Barry Seal. “He’d be in one city, tell me he was in another,” she told the Union Democrat. Philip and Ann Marshall were married for about three years starting in 1985. Kallauner, who lives in Louisiana, was also surprised at the allegation, “I don’t see him doing that without being in an altered state.”

Philip Marshall began flying at age 15. The young pilot’s first flight instructor was his father. On 9/11, after the second plane struck the World Trade Center, Marshall’s father called him from New Orleans, the city where Philip was raised. From his Santa Barbara home in Northern California Marshall picked up the phone, “Phil, thank God you’re home.” Marshall’s father added, “There’s more planes missing.” In Richard Clarke’s gate-keeping book, Against All Enemies, Clarke wrote that on 9/11 there were more than a dozen planes missing that day.

As Marshall watched the events of September Eleventh unfold, he began to make connections between the terrorist attack and the fictional book he was about to publish called “Lakefront Airport.” In The Big Bamboozle Marshall writes, “I remembered, through a rush of shock and awe, my work over the previous ten years, the hundreds of hours at this desk, on layovers, studying the new inexorable power that had invaded America, the bull in the china shop that had already caused havoc in my career and the undercurrent of deep mistrust amongst our pilot association. The culmination of that research was nearly finished, and because there were so many holes in my understanding at that time [Lakefront Airport] was written as a novel based on my time flying for the spooks back in the 1980s.”

Even before 9/11 Marshall had “a sick feeling that America was in deep trouble, that a group, this new Bush Administration, just like the old Bush Administration, was an incredibly dangerous, brazen bunch of well-connected, well-educated ideologists. They were on a power trip similar to others in world history, but as far as I knew this was the first attempt by what our founders had labeled domestic enemies to overthrow the Constitution and place America under their own absolute power.”

Many news reports have been quick to echo what the Calaveras County Sheriffs Department has claimed; Philip Marshall killed his two teenage kids, his dog, and himself. What we know is that there is no motive for the allegation, and we know that this conclusion was made the same day that the three bodies were found. The family dog was found in a bedroom, the two kids were found “sleeping” on a couch in the front room, six feet away from each other, and Marshall was found face-up near the front door, in a pool of blood with his gun next to him.

The biggest conspiracy theory here is the one that the police have come up with. Have they tested Philip Marshall for gun residue (ballistics testing)? The police department have not released any information about this question and I haven’t seen it asked in the local news reports about Philip Marshall.

The Calaveras County coroner, Kevin Raggio, claims the two teenagers, Alex (17) and Macaila (14), appeared to be “sleeping.” Joel Metzger, of Calaveras, points out “It’s highly unlikely Marshall could have shot one without waking the other.” Metzger reports that Sgt. Chris Hewitt was asked about this. Hewitt responded by saying he could not comment on it, “It’s part of an active investigation.” I thought they had concluded their investigation when they determined Marshall was guilty of a double-murder suicide? Perhaps the investigation is still “on-going” because the police have no motive, no suicide note, and no indication that Marshall fit the profile of someone who murdered the two people closest to him, his own flesh and blood.

Some would say that Marshall did this because of the separation and future divorce to his second wife, Sean Marshall. That is a theory to which there is no evidence. Critics point to a December 2008 dispute Marshall had with Sean and her sister, Erin, over the custody battle of the kids. Marshall was accused by Sean and Erin of slapping Erin at the Forest Meadows home. Marshall was detained, not arrested, and eventually released.

A month earlier in November, Philip Marshall hid in the shower of his house with a video camera as Sean entered the home and allegedly stole a bottle of six 20-milligram pills of Kadian; a very strong opioid.

The police were called out and eventually arrested Sean Marshall, charging her with petty theft, trespassing and possession of drugs without prescription. The charges were dropped on September 28th, 2009. When asked by police why she took the pills, she told them she hid the pills in a tree and planned on giving them to her lawyer.

A divorce hearing was scheduled for this week, February 25th, 2013. Sean Marshall filed for divorce in October 2012. Though the police have no motive, and it’s possible they never will, there are theories that one of the reasons why Philip would kill his kids is over the divorce. Again, this makes little sense considering the age of the children. If Philip Marshall was as close with his kids as friends and neighbors claim, then he didn’t have to worry about losing his teenage children in the custody battle. Alex was 17, almost an adult, who could make his own decision as to where he wanted to live and why. Though Macaila was 14, I believe the judge would have asked her where she wanted to reside, with the mother or father.

Since the two teens went to a high school near the Marshall residence and were active in both social and sporting activities, there’s little doubt the teens would want to finish high school at Bret Harte Union High. Philip Marshall was heavily involved in their school activities as well. So for me, the “If I can’t have the kids, nobody can” theory is very weak.

Bob Freels, security guard for the gated-community of Forest Meadows told the Union Democrat, “I would never have guessed anything like this.” He describes them as a normal family.

Bret Harte Union High School’s Assistant Principle Kelly Osborn is quoted as saying, “It just doesn’t make sense.” A neighbor named Mike Brown described Mr. Marshall as a dedicated father and Merita Calloway of the Calaveras County Board of Supervisors said Marshall was very involved with his kids.

Joel Metzger, of Calaveras, reports that Calloway also said, “the actions don’t match the person we know” and “he loved his children.” Nextdoor neighbor Carolyn Greenwood said, “I knew him long enough to know he was a regular guy. He was a good father, always there for his kids and a helpful neighbor.” More to the point of foul-play, Merita Calloway, who also lives in the gated-community, told a sheriff’s captain that she “truly felt like somebody came in the house.” While visiting Murphys soon after the incident, Wayne Madsen learned that a side-door was open when the bodies were found.

As seen above, the same day the bodies were found the police released a statement claiming “the reason for this murder-suicide is unknown at this time.”

So where is the motive provided by the Calaveras County Sheriff’s office? They have none. The people who lived near Philip Marshall and communicated with him have a hard time believing Marshall would kill his two children. There is no suicide note and no motive. Also, no one heard any gun shots between Thursday, January 31st and Saturday February 2nd, 2013.

On February 3rd Sgt. Chris Hewitt made it clear the police investigating the crime do not believe there was foul-play. “All evidence and information at the scene confirmed this was indeed a double-murder suicide and there was no evidence to suggest there was an outside party who entered the house and committed a triple murder.” I hope part of their evidence is gun residue found on Philip Marshall. Of course, the police can’t even determine the time of death. They can only theorize on that too. It happened some time between Thursday and Saturday. The autopsy results by Calaveras County coroner Kevin Raggio confirmed what we already knew – that all four died from a single gun shot wound to the head. The toxicology report, which may not be released for a few more weeks, will hopefully shed some light on what really happened to Marshall and his family. Until then, I don’t see how anyone can conclude this was a double-murder suicide.

I believe Marshall, his two kids, and the family dog (a small shitzu) were murdered one or two days before the Superbowl; which happened to take place in Marshall’s hometown of New Orleans. There is just as much evidence, if not more, to suggest foul-play as there is to suggest a double-murder suicide. Yes, Marshall had a Glock 9mm registered in his name, but where is the ballistic evidence to prove Marshall fired the weapon? Even then, how could the police rule out foul-play the same day the bodies were found. More so, if the investigation was on-going on Superbowl Sunday, why was a clean-up crew removing evidence from a crime scene?

On February 19th, Wayne Madsen told Alex Jones of, “Police said even before they had finished investigating the case, they permitted professional cleaners to come into the Marshall home to clean the premises. After that, there were two sets of vehicles seen at the Marshall home still conducting the investigation after the home was professionally cleaned.”

Madsen, of The Wayne Madsen Report, was in the town of Murphys right around the same time I was. On February 13th, Sean Marshall and her sister were at Bret Harte Union High School near Murphys for some type of ceremony for the two slain teens. The sister, Erin, gave some type of eulogy and Sean gave the closing statement. It’s not clear if either two women think Philip Marshall is guilty or innocent of this crime. Sean was quoted as saying, by Joel Metzger, “Being in Turkey and getting the news, it was almost unbearable. When I heard of this devastation, there are no words ever to explain the emotions, the hurt, the regrets. I couldn’t hear God at that moment. I couldn’t hear his answers why, why would you do this? Why them? Why me? Hug everyone, love everyone, be kind.”

Why blame God? Why not blame the ones who murdered Philip Marshall and his two kids? Shall we just trust in what the police say? Should we believe, without evidence, that Philip Marshall murdered his two children, his dog, and then shot himself on the left side of the head?

Wayne Madsen was in Murphys the same day as the ceremony. That night, on February 13th, Madsen told Infowars Nightly News host Jakari Jackson, “that evening, someone tried to break in through a sliding door at the back of the residence. It’s quite clear that Marshall has something that somebody wanted so bad, they were willing to kill him and his children and his family dog for.”

Barry Seal

Conspiracy theories continue due to the unanswered questions, not because of Marshall’s past. Examining Marshall’s past brings us to Barry Seal. Barry Seal’s wife once said that her husband flew the getaway plane out of Dallas after John F. Kennedy was killed. It’s believed that Seal began flying for black-op missions in the 50’s and hired Marshall in the 80’s after Seal lost his pilot’s license. Marshall told Coast to Coast that many of the contract pilots did not know what their planes were carrying. Both Seal and Marshall were involved in smuggling arms and drugs into South America. Barry Seal had ties to David Ferrie, who was also a pilot at one time. 1967, David Ferrie was questioned by District Attorney Jim Garrison about his involvement in the assassination of John F. Kennedy. Ferrie lied to Garrison about his whereabouts of November 22, 1963. Soon after Ferrie met with Garrison, Ferrie allegedly committed suicide. On February 19, 1986, Barry Seal was shot multiple times while attempting to exit his car. Seal was going to testify that George H. W. Bush was involved in the smuggling operations. Barry Seal may have been involved in what is know as Operation 40; the alleged hit team that was ordered to kill JFK on November 22, 1963.

Philip Marshall’s fictional Lakefront Airport is about Barry Seal and his CIA-connected smuggling operations involving contract pilots.

According to page 152 of Philip Marshall’s last published book, The Big Bamboozle, “Barry had some wild encounters with with the world’s most dangerous people that included cocaine kingpins and Intelligence Community assassins.” In Marshall’s only “fictional” book, Lakefront Airport, he told the tales of Barry Seal’s “dealings and eventual sting on the notorious Pablo Escobar” as well as Mr. Seal’s “early days of smuggling marijuana and explosives and his dealings with Ollie North and George H. W. Bush’s secret operations south of the border.”

On page 153,Philip Marshall refers to Barry Seal as his former boss. “The third man from the left is my former boss Barry Seal.” This picture was taken in Mexico city on January 22, 1963, at the La Reforma nightclub. Of the picture Marshall writes, “Here may very well be the founding members of the Intelligence Community’s Special Activities Division. This photo was taken ten months before President John F. Kennedy was gunned down in Dallas. Some independent investigators believe that this was the assassination team, nicknamed Operation 40, that pulled it off.”

My Trip To Murphys

My friend Patrick Henningsen of 21st Century said Murphys is “probably the most picturesque town in North California.” Well said.

Wayne Madsen confirmed everything I learned on my trip to Murphys, and so much more. If not for Wayne’s excellent work, I might have reserved some judgment for a later date. It’s clear to me that many people in the town of Murphys do not believe the official story about Philip Marshall. I hope this revelation will help them consider that 9/11 was an inside job, as Marshall believed. He made direct ties between the hijackers, the flight training they received inside the United States, and the Saudi Arabian Government. It’s believed the Saudis and others financed the terrorist operation that killed over 3,000 people, spawned two unconstitutional wars, created the Patriot Act and made room for N.D.A.A. legislation where the president could detain anyone suspected of working with terrorists whether they are citizens of the United States or not. Due process died on 9/11. Even worse, many believe due process died a long time ago.

On February 19th, Alex Jones told the audience, “I talked to Colonel Marshall [of] the Defense Language School. He said, “All I know is Mohamed Atta trained in my class.””

“The official version about some ghost (Osama bin Laden) in some cave on the other side of the world defeating our entire military establishment on U.S. soil is absolutely preposterous… The true reason the attack was successful is because of an inside military stand-down and a coordinated training operation that prepared the hijackers to fly heavy commercial airliners. We have dozens of FBI documents to prove that this flight training was conducted in California, Florida and Arizona in the 18 months leading up to the attack.” – Philip Marshall (2012)

When Philip Marshall saw the second plane hit the World Trade Center it would set him on a course to discover the truth about 9/11. He came to realize that the Osama bin Laden “killing” on May, 2, 2011 was a farce. I have covered this in my own book, False Flags. Actually it appears Marshall began seriously researching 9/11 around the same time as I did.

Philip Marshall was not killed because he wrote a book on 9/11. Many people have done that. Can we prove he was killed as part of a black-op? Not at this time. Yet we know Marshall had dealings with black-ops and that he knew a lot of key players in the Iran-Contra scandal and the sting of Pablo Escobar. As a pilot Marshall understood that the official story about a plane hitting the Pentagon was not true. To this day, the government has not provided any proof of their own conspiracy theory of what happened at the Pentagon on 9/11.

One of the questions I have is how Marshall’s children felt about their father’s books. Apparently, on Macaila’s Facebook page there’s a link to her father’s book on 9/11.

Finally, we have the tie-in to more gun control. This time, the high school where Alex and Macaila Marshall attended has created a bereavement fund that includes a scholarship for future students. One of the considerations for the scholarship is the student’s view on “gun control regulations in the community.”

“A bereavement fund for the siblings has been set up at the U.S. Bank branch in Angels Camp. Donations can be made out to Alex and Macaila and mailed to the bank at 580 S. Main St., Angels Camp, CA 95222. The donations will go toward the memorials and a student annual scholarship for Bret Harte High School. The funding will consider students who are involved with the promotion of mental health awareness and gun control regulations in the community, according to organizers.”

Students were told instead of paying admission for that Friday’s school dance, they could donate to the bereavement fund. While I am happy there is a bereavement fund to honor the two teens, I am disgusted that the “organizers” would use such a tragic event to promote more gun regulations.

With all the surrounding questions, what is the big picture here? What is the Big Bamboozle?

    The toxicology results should be in any time now. I guess the coroner hopes testing for drugs will make sense out of how the two kids who died on Saturday at 3 pm and/or Thursday night slept through getting shot along with their dog (but not the cat)

    Among other strange details, the above article indicates that the wife whose account is the only person that knew him personally that provided a damaging character reference may have been video taped by Philip Marshall stealing opiates, after which she was arrested for breaking and entering, burglary, and possession of a controlled substance. Is that the ‘nurse’ who had so much to say about the man? But to balance things out the report also points out that someone somewhere who thought he may have been spiraling into depression (which is not substantiated by the consistency of his posts from Jan 12-Jan 31, see twitter link below), and that this same ‘psychology expert’ evidently thinks that 91 percent of all males are likely to commit murder-suicides — or whatever that statistic is supposed to mean.

    The sheriffs also allegedly said they’d look into whether or not Marshall was mentally ill and on medication, but that they would not release the results. Probably out of sensitivity for the accused suicide-assassin’s reputation, we might assume.

    Fortunately for the sheriffs, their alibi is that their press release is barely what could be called “sketchy”. The press evidently pulled details such as the time of death out of thin air, which would be unnecessary if the coroner actually DID take the liver temperatures or other tests (which might show signs of struggle), as he said he would do. But apparently didn’t.

    Note: If the cat was wounded in the senseless slaughter we may never know because the sheriffs quickly destroyed the evidence at the crime scene after their hasty conclusion as to what happened. The sweetest memorial to the family would be if a neighbor found the cat and took it in, I would think. But nobody’s talking up there. It’s almost like the whole area has been “terrorized”.

    In fact they didn’t tell whether paraffin tests were done, ballistics tests to see if Marshall was indeed the killer. And if the cat was wounded, nobody will ever know. A man this crazed would at least try to kill both of the family pets too, you’d think.

    And there’s no mention of photographs that might have been taken prior to the hasty cleanup of the crime scene. It appears that they relied only on ‘evidence found at the scene’, which is NOT specified in the press release. And the only information forthcoming is therefore word-of-mouth, or hearsay.

    So we ask, “WHAT EVIDENCE” was the conclusion that nobody else could have killed them all based on? Was there any? Is there any now? And who were the deputies that first advanced the “sleeping while getting shot” theory?

    Why wasn’t the fact that he was found laying on top of the alleged murder weapon not mentioned in the press releases?

    The coroner said he’d measure their liver temperature to figure out a time of death. The Feb 4th press release suggests that he never even did that.

    And then there’s a question as to whether or not he killed any of them, actually.

    Phil was NOT depressed. He did NOT take his life. He did NOT murder his kids. Only a few days ago he said that “I have a gun, but it would be useless if I needed it because I got no bullets for it”, (then he laughed!). I knew Phil, and he had everything to live for and he doted over his two beautiful kids.

    And it appears that the sheriffs themselves may not have been so sure either. For example, why did they contact the county supervisor that lived four doors down from Philip Marshall? Was it to get her opinion or to shape it.

    Since the kids quit responding to text messages on Thursday and they didn’t go to school Friday, the coroner’s theory that the sleeping children were killed on Saturday afternoon (when the bodies were found) may be flawed. And if it is flawed, the most likely times of death would be Thursday.

    Notice that his posts are consistent in their tone from Jan 12 to Jan 31 (the Thursday the family most likely died). One interesting change though is his change from using to about a week before his death, and another interesting detail is a broken link to an article that was about rupert murdoch and the movie zero dark thirty.

    So the only solid evidence publicly available besides the sheriffs and coroner’s hearsay and unsubstantiated theories appears to contradict their conclusion. Twitter pages, friends posts. Exclude the self contradictory statements of ‘fact’ from the sheriffs’ department including the physical near-impossibility that his body fell on top of the murder weapon.

    If they have photos of the crime scene or other evidence that could make sense of their conclusions it would be in the public interest as well as their own to publish that evidence. If they do have this important data, how long should ‘news’ be ‘aged’ before it becomes relevant?

    Wayne Madsen scooped the story and has learned that Philip Marshall was right handed and that he died from a gunshot to his left temple. That he was right handed can be verified by photos on the net. That he was shot in the left temple can NOT be verified. And so how did Madsen come across this information and is it even reliable? How does he know? Did he get it from the sheriffs? Not to kick a dead horse, but did they take photos of the crime scene before destroying the evidence or is Madsen now also relaying hearsay as fact. has closed the thread (search “philip marshal victim”), just as the final insult is due in from the lab in Sacramento.

    Looks to me like this football field has the field goals, not in the end zones, but at the cheerleaders’ benches.

    That wasn’t so different from the state of things during Alex and Macaila’s lives, when at least 10 friends would sleep over each weekend.

    She planned to talk at some future time about mental illness and guns.

    It is not clear where this ‘mental illness’ diagnosis came from, however, as it appears the Philip Marshall had been given custody of the kids by the courts (unverified but we know where the kids were living).

    There’s no indication that Philip tried to limit contact with their mother or refused to let them travel with their mom.

    Best wishes and deepest condolences for Seanie’s loss and for her courage in facing the future that she tried to secure for the children.

    And a theory. It’s my own: Looking at this situation as a black box with nonsense and conflicting information as an input and confusion as an output, what if the sheriffs and coroner are deliberately sounding like mad hatters in order to generate debate about non-issues and “theories”? What if they hope to set the believers and disbelievers against one another in order to assure that justice is derailed?

    Then if someone were to feed nonsense into this black box, if they had the brains of a mollusk wouldn’t they try to get the optimal confusion as an output?

  2. You misunderstood her post. Ann said that when Phil worked for Eastern, he would say he was in one city but was in another. He would do this because he was planning to sleep with one of his flight crewmembers and did not want to be interrupted by a call from his wife. This was not an unusual pattern of behavior for him. This was before
    the era of cell phones, etc.

Marshall wrote his death sentence when he bought a gun-the assassins “the us government ” the 911ers have full access to firearms purchases-records-which from that moment they had a way to murder him and call it suicide-you can bet the entire neighborhood was surveiled for months to learn all his families and neighbors patters habits-including CIA- assets to know when the last neighbor turned off his laptop.ect and went to sleep. The killer likely appeared around 4am when people and a neighborhood are deep asleep. the killer likely was dresses as a law inforcement person-or someone familiar to Marshall -when he answered the door-a pistol was placed against his left temple by a right handed person and bang-no bang-a silencer—Marshall had not bought bullets. The killer may have entered the house while all were gone-killed the dog and then waited in ambush. The killer, the government will never investigate this murder-its the same government that never investigated the JFK murder. That sheriff department was also corrupted. Everyone eventually is in peril. Look at the two innocent children struckdown to coverup the mission. Silence Marsall who tells the country how to react to 911 on page 157 of The Big Bamboozle.

  4. I hope I do understand her point of view. My only reason in mentioning her quote was to show she did not always know where Marshall was, so when she claimed that Marshall was not involved in the iran/contra affair, it was just to show that i don’t think she could know for sure. More so, it goes against what Philip Marshall has stated in The Big Bamboozle. But I’m just a third-party person researching this. and I’m glad people like you care about this topic too. Thanks for making the point. I totally agree. that was 1985-88. I wasn’t 10 years old yet.

  5. Entering the Defense phase…

    Re. “Phillip Marshall CIA” on the net.

    Previously I analyzed the sheriffs’ report on their alleged investigation of the three deaths in Murphys CA, which supported their initial findings.

    If the sheriffs hadn’t concluded that Phillip Marshall was the shooter in an alleged murder-suicide before doing their investigation, I probably wouldn’t be doing this. But they said that persons from outside had been “eliminated” the same day the bodies were found at 3 pm in the afternoon and puzzling inconsistent reports and loose ends remain troubling to this day.

    Nobody has control of the evidence but the sheriffs and the coroner. And their investigation appears to be tailored to match their conclusion by cherry picking certain “conspiracy theory” points while not addressing the basic point, that if the man were still alive he’d have an opportunity to defend himself and if he were found innocent the real killer(s) who could still be at large might be apprehended.

    The right to a defense is key to our notion of “establishment of justice” in this nation, and among the elements the founders considered crucial to this proposal, as seen in the US Constitution, Amendment 6, is the right to counsel and compulsory process to obtain witnesses for his defense.

    The sheriffs apparently had no interest in defending the accused (Phillip Marshall) and only had an interest in debunking “conspiracy theorists”.

    One such conspiracy theorist who has gained the most attention was Wayne Madsen who went to Murphys and investigated this issue himself and concluded that the CIA had executed the man and his kids. The key point and the weakness in his theory was that Marshall was shot in the left temple, though he was right handed. Where did Madsen get this report? Was it the same source that told the Union Democrat that the “official time of death” was when the bodies were found?

    So numerous conflicting and/or absurd reports have come out about this case (I’ll call it a “case” because I’m handling Phillip Marshall’s defense in lieu of someone more capable), and since no photographic evidence of the crime scene appears to have been preserved (that we know of) to resolve these conflicting reports, the only evidence we do have is the sheriffs reports themselves, along with some followup media interviews which fill in the blanks or make sense out of the odd sounding parts of the third report. The third report is now two months after the event and which (as mentioned above) was not done before they had already concluded that Phillip Marshall was the shooter and appeared only to bolster their initial reaction to the appearance of the crime scene, which was published within two hours of finding the bodies if the report was typed up during normal business hours (assuming 5 pm).

    The date of the first report is the date when the bodies were found.

    The update/correction report came out two days later.

    Then two months passed before the third report.

    Phillip was characterized as a drug crazed, mentally ill “truther” in the media, and by the sheriffs themselves. That he was what has been called a “truther” (generally also a “Bush-basher” due to the 9/11 attacks occurring during the Bush administration) is not in dispute. But the evidence suggesting that he was mentally ill and/or drug crazed is weak or non-existent. Moreover, his parenting ability might be better than anyone expected, though this is not pointed out in the investigation. Nevertheless, it can be seen within the supposedly incriminating evidence against him found on the net an in the sheriffs own investigation reports.

    Was Phillip Marshal drug crazed?

    Phillip had had an alcohol problem in the past but appeared to have cleaned up. The mom, at around the same time had an opiate addiction and she too had apparently cleaned up.

    [In 2008] Philip Marshall hid in the shower of his house with a video camera as Sean entered the home and allegedly stole a bottle of six 20-milligram pills of Kadian; a very strong opioid.
    The police were called out and eventually arrested Sean Marshall, charging her with petty theft, trespassing and possession of drugs without prescription.

    The Calaveras County District Attorney’s Office charged Sean Marshall with petty theft, trespassing and possession of drugs without a prescription. Court records show the case continued in the Calaveras County Superior Court while she attended Alcoholics Anonymous and/or Narcotics Anonymous meetings. After providing an attendance card at a Sept. 28, 2009, hearing, all charges against her were dismissed.

    Philip and Sean Marshall/Plummer both appeared to have resolved their drug/alcohol issues by early 2009. The conflicts and previous divorce issues arose during the time prior to them “getting on the wagon”. And the previous divorce proceedings were also dropped and the marriage continued up until a few months before they split up and Phillip moved back into his own home.

    Why did Sean want a divorce again? Why was a note to Sean found in Phillips safe saying “Hi Sean” on a bag of marijuana? And why were the drugs in a safe in the first place?

    This reflects on Phillip Marshall as a former airline captain and a parent: Were the drugs in the safe to keep the kids out of them (all of which were legally prescribed, including the marijuana)?

    If they were not in the safe to keep the kids out of them it was to keep the mom, Sean Marshall/Plummer out of them. She’d robbed drugs from him before.

    As Phillip has a right to a defense, it should be pointed out that if keeping the drugs, gun, bullets, etc. in the safe was to prevent the kids from getting into them, this suggests that he was a careful, caring parent.

    Why the details about the safe were not forthcoming in a more timely manner (such as in the first or second media releases of their reports) is unknown. The last update comes two months after the first two hasty conclusions and gives the impression that the public had no right to know how they arrived at their conclusions.

    Conclusions such as the snap decision that Phillip Marshall shot his kids in the living room, then the dog in the master bedroom and then himself back in the living room again. (If the dog was shot first, the kids could not have been “sleeping”.)

    Was Phillip Marshall mentally ill?

    That Marshall was taking Welbutrin (the common name) for something appears to be certain from the toxicology results. But what was it prescribed for?

    PARENTS: Do you have any kids that are taking Welbutrin? This is indeed the same stuff Phillip Marshall was taking.

    Some antidepressants are used to block pain. Welbutrin is not effective for this, and so it makes sense that Marshall would use additional drugs for the chronic back pain he suffered. The morphine and oxycontin both appear to have been prescribed to him and he appeared to have been using them properly as the amounts in his blood were a tenth the amount of the anitdepressant which itself degrades quickly if not kept at the “coldest possible temperature” before doing a toxicology analysis (according to a wikepedia article on the drug).

    The sheriffs reports and interviews point out that Phillip Marshall was required to fill out a contract promising to take the drugs only as prescribed and not to attempt to get additional drugs from another source. This is very likely a standard form. But the “local clinic” that required this agreement was not specified in the report so we can’t verify this. Adding to the difficulty in verifying this using the internet (my only resource) is the fact that there are no “local clinics” in Murphys.

    There have been no photographs forthcoming to verify that bedding was present where the kids were allegedly sleeping when shot. And no name of the “local clinic” in order to verify that the contract is standard.

    We are beginning to see a pattern like a game of “keep away” where the sheriffs have the ball and the public is in the middle. All we want is the truth. And we deserve it in a timely manner.

    But as is evidenced by the lack of a time of death which was “being evaluated” from day one and is still estimated as being between Thursday night and the Saturday afternoon when the bodies were found, timeliness doesn’t appear to be much of an issue to the sheriffs — or are we to presume a time of death will become more certain after a two month delay.

    The two months was apparently necessary to just bifurcate the “official time of death” to possibly include the night before the kids failed to go to school. That is the only change regarding the time in the latest report.

    Thursday night the kids quit posting on internet. (Jan 31)
    Friday they didn’t go to school. (Feb 1)
    Saturday they were found dead at 3 pm. (Feb 2)

    This lack of diligence in getting the time of death down to at least within a day is unacceptable. Were the kids drinking on a Thursday night or on a Friday night. Was it night time?

    But decibel tests were done on a Saturday morning. Around 10 am. Why? And what time of year was it when the tests were conducted? It had been the cold of winter when they died but was already substantially warmer by the time they released of the third report. (Feb 2 vs. March 29, just one day before April.)

    It must have been night time if the kids were indeed sleeping at the time they were shot. Was the dad who was on the wagon aware they were drinking? (The dad was the only one without any alcohol in his toxicology results) What room or rooms was the beer and whiskey found in? Where is the self-portrait Macaila took of herself that night, and what room was she in when she took it?

    Most of the above questions can be answered. But if there are no photographs of the crime scene, it is necessary to ask why no ‘evidence’ was preserved photographically because there are still many many unanswered questions about lots of missing details.

    What criteria are used to determine whether or not a man is mentally ill or criminally inclined? Is it erratic, irrational behavior? Is it lack of openness, furtive, cagey, suspicious actions? Is it “medical records”?

    As we read the third report/update of their investigation and get into the part about “records, medical records and reports” we get the very strong impression that the only “diagnosis” that determined that Phillip Marshall had a bipolar-disorder was the sheriffs own desire to believe it was so.

    Are they again playing games with the public or is there actually “evidence” of this that they are not sharing with us.

    Here are some of the bizarre statements that result in their conclusion 2 months after the deaths, that Phillip Marshall must have had a bipolar-condition.

    1. According to records obtained, Marshall was diagnosed with bi-polar disorder. Additionally, the reports stated that he suffered periods of depression and mania, which led to his dismissal, or “grounding,” as a pilot in September 2006.

    Question: Were these or were they not “medical records”? Were they actually just “airline records”? Did a doctor provide the diagnosis? In the 6 years since he was “grounded” had nobody else given the same diagnosis? Wasn’t he supposedly taking medicine for this alleged “bipolar disorder”? Both wives had been interviewed, and both mentioned his temper and impatience, but neither of them used this word. Could it be the sheriffs mistook bipolar-disorder for what was actually adult ADHD? (See “Welbutrin” at wikipedia.) We don’t know. We SHOULD know. But the reason we don’t know is because of the inability or unwillingness of the sheriffs to show the ‘evidence’.

    Where did the one “diagnosis” of a bipolar-disorder that was cited actually come from?

    2. A search warrant was served at a local clinic for Phillip Marshall’s medical records. The medical records noted that he suffered from chronic back pain, and was prescribed prescription narcotic pain medications for this condition. His medical records suggested that he also suffered from some sort of mental illness, drug dependency, anxiety, and depression.


    What in the world kind of “medical record” would only suggest that “he also suffered from some sort of mental illness”? Weren’t previous records available to the clinic? Records that had the all-important “diagnosis”, that doesn’t really state anything conclusive, we presume was obtained from a legitimate medical professional?

    The likelihood of a prescription being issued for Welbutrin to deal with “some sort of mental illness” is quite a stretch. The only thing consistent with this verdict handed down by the sheriffs is this game of “keep away” with the real evidence.

    And so it goes. This is the new and improved “evidence” after the sheriffs determined with certainty that Phillip Marshall shot his kids while they were sleeping on a couch in the living room, then went into the master bedroom and shot the dog, and then went back into the living room and killed himself.

    How did the sheriffs “rule out” anyone from outside having committed the murders only hours after the bodies were found? That doors were unlocked in the home should have been known within the first minute after they arrived at the scene.

    Has any part of this so called investigation been objective, or has it all been tailored to shape opinions.

    Here’s an interview with one of Phillips neighbors, a county supervisor that said she knew Phillip well. How did her mind change from feeling someone must have come into the home to “you never know what goes on behind closed doors”?

    “The actions don’t match the person we know,” said Merita Callaway, a county supervisor who lives four doors up the street from Marshall. She considered him a good friend. “I can’t tell you how many times we’ve had conversations over a cup of coffee together.”

    “When I heard what happened, I couldn’t believe it,” Callaway said. “He loved his children.”

    She received a call from a sheriff’s captain asking her ‘Do you think this was a murder suicide,” to which she replied, “I had a hard time with it. I truly felt like somebody came in the house.”

    “What happened on Thursday that triggered this, if this was a murder suicide?” she asked. “Did he hate his family that much?”

    That being said, Callaway said, “I don’t know what happens behind closed doors.”

    Indeed, that is the problem. You never know what goes on behind closed doors and so if the sheriffs have any real evidence, photographs of the crime scene (or artists cleaned up renderings for the public), Macaila’s self portrait, photocopies of the documents they say they have, or knowledge of the exact time of death (see note above), at the very least, the press should be allowed to see them, and better than that, some method of impartial review, because this game of “keep-away” is unacceptable to the public who entrust their safety to law enforcement personnel (see the US Constitution, Preamble).

    If they are wrong. The killer(s) are still at large. Think about that for a moment.

    And it’s totally unacceptable to my “client”, Phillip Marshall, who has a right to defend his name, even after death, which I have volunteered to attempt, though I never even met that man and I have zero expertise in law, and I have no college education in any subject.

    I just a desire that this republic live up to the Constitution that is still the legally binding Supreme Law of the Land.

    And because his kids can’t do it for him.

    Note: For those who are technically minded, we don’t go into details such as how voids inside voids in blood patterns might not be apparent (like shadows not showing inside other shadows) because indeed we don’t know if the sheriffs even bothered keeping photographic evidence showing anything at all. There is no way to verify their findings and the home was immediately cleaned up. If photos exist that could be analyzed, the sheriffs seem to be playing keep-away with them too for some reason and it’s not worth trying to anticipate their next move in the game they are playing at this time.
